Background
In recent years, Abu Dhabi (both the capital and the largest of the seven Emirates) has rolled out a number of economic reforms to diversify its economic base, one of which being the creation of the Abu Dhabi Global Market (ADGM) pursuant to Abu Dhabi Law No. 4 of 2013, creating a world-class legal system and regulatory regime. More than just another free zone, the ADGM is geared towards becoming a world-leading financial centre.
Statutory framework
By passing the Application of English Law Regulations 2015 (Application of English Law Regulations), the ADGM officially adopted “the common law of England (including the principles and rules of equity), as it stands from time to time”, which increases the level of legal certainty and gives us and our clients a high degree of comfort when structuring foundations and companies in the ADGM.
Beyond this broad framework, specific legislation has also been introduced in a highly tailored manner to cover matters of particular concern such as companies, insolvency and financial services law.
The ADGM’s Anti-Money Laundering and Sanctions Rules and Guidance was modelled after international best practise and provides a comprehensive risk-based framework contributing to the ADGM’s reputation as a robust jurisdiction.
